Bin Valet Services Residential Service Agreement & Terms of Service
Last Updated: October 25, 2026
Please read these Terms and Conditions ("Agreement") carefully before subscribing to or using the services provided by Bin Valet Services. By enrolling in our recurring services, creating an account, or submitting payment, you ("Customer," "Client," or "you") agree to be bound by the terms outlined below.
1. Scope of Services (Pure Valet Model)
The Company provides residential curbside bin-movement logistics. Services are strictly limited to:
- Curbside Roll-Out: Transporting municipal waste, recycling, and organic/yard waste rolling containers from their designated outdoor on-property storage location to the public street or curb prior to scheduled municipal collection.
- Return-to-Property: Transporting empty municipal containers from the public street or curb back to the Customer's designated on-property outdoor storage area after collection.
Explicit Non-Hauling Notice: The Company is an independent bin concierge service and is not a waste hauler, trash collection agency, junk removal company, or municipal contractor. Under no circumstances does the Company transport, remove, haul away, or dispose of loose trash, extra bagged waste, bulk items, or recycling placed outside the containers.
2. Service Timing & Operating Windows
2.1 Staging Window (Day Before Collection)
Bins are staged at the street or curb on the calendar day immediately preceding the local municipality's scheduled pickup date, typically between 4:00 PM and 9:00 PM local time.
2.2 Return Window (Within 24 Hours)
Empty bins will be retrieved from the street or curb and returned to their designated storage spot on the Customer's property within twenty-four (24) hours following the municipal waste truck's collection run.
- Municipal Delays: If the municipal waste collection truck is delayed due to severe weather, vehicle breakdowns, municipal holidays, or labor strikes, the Company's 24-hour return window begins only after the bins have been physically emptied by the municipal hauler.
3. Property Access, Clear Pathways, & Security
3.1 Granted License for Entry
Customer grants the Company and its authorized personnel an express, revocable license to enter the exterior grounds of the designated property (specifically driveways, exterior walkways, side yards, and designated bin storage enclosures) during operating windows to carry out the agreed valet services.
3.2 Clear & Safe Pathway
Customer agrees to maintain a safe, unobstructed path between the bin storage area and the public street. This includes, but is not limited to:
- Removing parked vehicles, trailers, bicycles, toys, gardening hoses, and equipment blocking the route.
- Keeping pathways reasonably free of hazardous ice, snow accumulations exceeding 3 inches, or deep mud.
- Ensuring low-hanging branches, hedges, or thorny shrubs do not obstruct a clear walking path.
3.3 Gates, Latches, and Access Codes
- If bins are stored behind closed or locked gates, Customer must provide current gate combinations or access codes, or ensure the gate remains unlocked during service windows.
- Company personnel will make reasonable efforts to close and latch gates upon exit. However, Customer remains responsible for verifying gate security.
3.4 Inaccessible Property (Skipped Service)
If Company personnel cannot safely reach or maneuver the bins due to locked gates without supplied codes, unrestrained animals, heavy snow or ice hazards, or vehicles blocking the path, that scheduled service run will be marked as Skipped Due to Property Inaccessibility. Customer remains responsible for full service fees for that billing cycle; no credits, make-up visits, or pro-rated refunds will be issued.
4. Cart Integrity, Overflow Waste, & Heavy Loads
4.1 Strict Exclusion of Outside Waste
- All refuse and recyclable materials must be entirely contained within the municipal-issued rolling carts.
- Any loose items, extra trash bags, yard waste bags, or cardboard boxes placed on top of, behind, or next to the municipal carts will remain untouched on the property. Company personnel will not handle or transport loose items.
4.2 Closed Lid Policy & Weight Limits
- Customer is responsible for ensuring bin lids close reasonably flat to prevent wind-blown litter and pest intrusion.
- Carts must adhere to standard municipal weight ratings. If a bin is dangerously overloaded (e.g., filled with concrete, wet soil, gravel, brick, or dense tile) to the point where structural failure, wheel collapse, or physical injury is likely, technicians may leave the container in place.
5. Pet Safety & Animal Containment
- Mandatory Restraint: Customer agrees to keep all dogs and other domestic animals securely indoors or confined in an area entirely separate from the bin path during service windows (from the afternoon prior to collection until the bins are safely returned).
- Escaped Animals: While Company technicians take reasonable care to latch gates upon exit, the Company accepts no liability for domestic animals that escape, cause property damage, or suffer injury if left unrestrained in the yard during scheduled service days.
- Aggressive Animals: If an unrestrained animal displays hostile or aggressive behavior, personnel are instructed not to enter the yard. The service will be skipped without credit or refund.
6. Property Damage, Pre-Existing Conditions, & Limitation of Liability
6.1 Normal Wear and Cosmetic Deterioration
Customer acknowledges that repeatedly rolling heavy containers across outdoor surfaces may cause routine cosmetic wear over time. The Company is not liable for:
- Normal cosmetic tire scuffs, natural wear on driveway sealants, surface scuffs on concrete or decorative pavers, or displaced loose gravel.
- Structural failure of aging wooden fences, rotted posts, loose hinges, or previously corroded latches resulting from ordinary gate operation.
- Manufacturing defects, brittle plastic, cracked bodies, detached lids, or broken wheels inherent to the municipal carts.
6.2 Pre-Existing Damage Documentation
The Company reserves the right to capture date-stamped photographic records of damaged gates, blocked driveways, loose animals, or compromised containers prior to or during service.
6.3 Limitation of Liability
To the maximum extent permitted by applicable law:
- The Company's total cumulative liability for direct physical property damage caused by the proven gross negligence or willful misconduct of its personnel shall be strictly limited to the actual, reasonable cost of repair, not to exceed $1,000 per incident.
- Under no circumstances shall the Company be liable for incidental, indirect, consequential, punitive, or special damages, including but not limited to lost rental income (such as short-term rental or Airbnb cancellations), HOA fines, municipal citations resulting from factors outside Company control, or pet incidents.
7. HOA & Municipal Citations
While Company services are designed to assist homeowners in complying with neighborhood and Homeowners Association (HOA) rules, the Company is not responsible for HOA fines or municipal citations resulting from:
- Incorrect pickup days or schedule adjustments submitted by Customer.
- Delays or missed collections caused by the municipal sanitation department.
- Inability to access the property due to locked gates, adverse weather, or physical obstructions.
8. Billing, Subscriptions, & Cancellation
- Automatic Billing: Services operate on an automatic, recurring billing subscription (monthly, quarterly, or annually) charged to the Customer's payment method on file.
- Failed Payments: If an automatic renewal fails, services may be paused after three (3) calendar days until billing details are updated.
- Cancellation Policy: Customer may cancel recurring services at any time through their online customer portal or by emailing written notice to binvalet.lethbridge@gmail.com at least five (5) business days before the next scheduled billing date.
- No Prorated Refunds: Subscription fees are billed in advance and are non-refundable. No prorated refunds or credits will be provided for partial billing periods or missed days resulting from customer-side access issues.
9. Inclement Weather & Force Majeure
Service may be temporarily delayed, altered, or paused without financial penalty in the event of circumstances beyond reasonable control, including:
- Severe weather events (blizzards, gale-force winds exceeding 40 mph, freezing rain, flash floods, or severe ice storms).
- Declared states of emergency, civic road closures, earthquakes, or public emergencies.
High-Wind Protocol: On days with official high-wind warnings or severe wind advisories, technicians may stage bins in a sheltered location near the driveway entrance or against a wall rather than exposed at the open street curb, exercised solely at the technician's safety discretion.
10. Governing Law, Municipal Compliance, & Dispute Resolution
10.1 Governing Law & Jurisdiction
This Agreement, its interpretation, and any disputes arising out of or related to it shall be governed by, construed, and enforced exclusively in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles. The parties irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Alberta, with the designated judicial venue being the City of Lethbridge.
10.2 City of Lethbridge Bylaw Compliance
The Company's bin placement and transit services are operated in accordance with the City of Lethbridge Waste Bylaw (Bylaw 6146) and the Traffic and Highway Bylaw (Bylaw 5834), as amended from time to time:
- Cart Placement Standards: Carts will be staged in the lane (alley) or street roadway gutter in compliance with City positioning standards (maintaining a minimum of one (1) metre of clear space on all sides from vehicles, fences, and utility infrastructure, and clear of overhead wires/trees).
- Timelines & Obstruction: In accordance with municipal regulations governing the obstruction of public roadways, lanes, and sidewalks, Customer acknowledges that the Company's service window (staging the day prior to pickup and returning within 24 hours of collection) is designed to keep carts off streets and public walkways outside scheduled waste days.
- Prohibited Discharges & City Penalties: Under Bylaw 6146, the property owner remains responsible for cart contents. The Company does not inspect, sort, add to, or dispose of cart contents. Any municipal administrative penalties, utility bill adjustments, or fines levied by the City of Lethbridge or Lethbridge Police Service for overfilled carts, unclosed lids, improper sorting (e.g., contamination in blue or green carts), or non-compliant placement caused by Customer instructions shall remain the sole liability of the Customer.
10.3 Informal Dispute Resolution
In the event of any controversy, claim, or dispute arising out of or relating to this Agreement or the services provided (including allegations of property damage or service disruptions), the parties agree to first attempt to resolve the matter amicably through good-faith direct negotiations. The complaining party must deliver written notice detailing the issue to the other party, and the receiving party shall have fourteen (14) calendar days to respond and propose a resolution.
10.4 Formal Dispute Resolution (Alberta Provincial Court)
If the dispute is not settled through informal negotiations within thirty (30) days of receipt of written notice:
- Civil Claims (Small Claims): Any claim falling within the monetary jurisdiction of the Alberta Court of Justice – Civil (formerly Provincial Court Civil Claims / Small Claims) shall be heard and determined exclusively at the Lethbridge Court House (320 4 St S, Lethbridge, AB T1J 1Z8).
- Court of King's Bench: Any dispute exceeding the monetary limit of the Alberta Court of Justice shall be submitted to the exclusive jurisdiction of the Court of King's Bench of Alberta, Judicial District of Lethbridge.
- Waiver of Jury Trial: To the maximum extent permitted under Alberta law, both parties voluntarily waive any right to a trial by jury in any proceeding arising out of or related to this Agreement.
10.5 Consumer Protection Legislation
Nothing in this Agreement is intended to limit, modify, or exclude any non-waivable statutory rights, warranties, or remedies available to the Customer under the Alberta Consumer Protection Act (RSA 2000, c C-26.3). Where any term of this Agreement conflicts with a mandatory provision of the Consumer Protection Act, that specific term shall be deemed severed or read down to comply with the statute, and all remaining provisions shall remain in full force and effect.
✅ Acceptance: I have read, understood, and accept the Terms and Conditions. I authorize Bin Valet Services to access my property's exterior grounds to move municipal bins, acknowledge that Bin Valet Services does not haul away extra waste, and agree to the 24-hour return and animal-containment guidelines.
